Frequently Asked Questions
The hearing on day five, six, and seven will focus on witness testimony. Here is some basic information in advance of the hearing. If you have not reviewed “Hearing Update: Day Three” please do so as this document contains a basic overview of witness testimony and related information.
- When and where will the next three days of the hearing be held? The hearing will continue on May 24, 25, and 26. It will be held at Cabrillo High School, 2001 Santa Fe Avenue, Long Beach, CA 90810 in the auditorium.
- Will these be the final three days? It is very likely these will be the final three days. However, the Administrative Law Judge will make the final determination.
- Do I need to attend if I have already testified or do not wish to testify? Your attendance is voluntary. However, if you are challenging your layoff, it is in your interest to continue to participate in the layoff hearing process so you do not relinquish any rights or information from the process.
- Why is the hearing process so slow? We understand that each day at the hearing is a day away from the classroom, but please keep in mind that the scope of the hearing is within the District’s control and the pace of the hearing is somewhat controlled by the ALJ. There are many of you who received “precautionary” layoff notices that the District still wants to keep in the layoff. The District can rescind a number of your layoff notices and still comply with the FTE reduction in the Board Resolution. However, they have chosen not to do so, even though doing so will reduce the length of the hearing, save money, and allow you to be with your kids in the classroom.
- Why doesn’t the District simply rescind the over-noticed teachers in order to shorten the hearing process? This is a great question, with no good response. They should do this for the reasons already stated under #4.
- What will be the order of testifying? This is somewhat dependent upon the judge. We will continue to try to get witnesses to testify in “like” groups (as described in the Day Three Update). Also, if we can get the District to stipulate to common facts it will help reduce the number of witnesses on any given topic. We will continue to post upcoming witnesses on the “Up Next” board as we have done previously.
- Will the recent tentative agreement save my job? Maybe. The agreement needs to be approved by TALB members before it goes into effect. There will be 200 jobs that are removed from the layoff list for the coming year as a result of the recent tentative agreement if TALB members vote to approve it.
- When will the District issue final notices? We believe the final notices will be issued on or about June 20, depending upon when the hearing actually concludes.
